§ 1 Scope and Contracting Party

(1) These Terms of Service (hereinafter “Terms”) apply to all contracts concluded via the platform discode.ai (hereinafter “Platform” or “Service”) between

(hereinafter “Provider”, “we” or “us”) and the person using the Service (hereinafter “User” or “you”).

(2) Discode.ai is an AI-powered multi-LLM router that automatically routes user queries to various AI language models. All responses generated via the Platform are produced by artificial intelligence systems.

(3) These Terms apply in the version valid at the time of registration or order. Deviating terms of the User are not recognised unless the Provider expressly agrees to them in writing.

(4) The Service is directed at consumers within the meaning of the Austrian Consumer Protection Act (KSchG) as well as businesses. For consumers, the mandatory provisions of the KSchG, the Distance and Off-Premises Contracts Act (FAGG) and the Consumer Warranty Act (VGG) take precedence.


§ 2 Subject Matter and Service Description

(1) The Platform constitutes a digital service within the meaning of § 3 Z 6 FAGG. The Provider grants the User access to a multi-LLM router that automatically forwards text queries to suitable AI language models from various third-party providers (including OpenAI, Anthropic, Google, Mistral).

(2) The Service includes, among others, the following features, whose availability varies depending on the chosen plan (§ 4): automatic model selection via four preference sliders (Speed, Quality, Budget, Eco), Turntable mode, Battle and Trio mode, Deep Research, image and video generation, GDPR anonymisation (PII detection and masking), Eco Score and a credit system (§ 5).

(3) The Provider delivers the Service using third-party AI models. The Provider is neither the developer nor the operator of these AI models but provides the routing infrastructure, user interface and additional features.

(4) The Provider aims for a Service availability of 99% on a monthly average. There is no entitlement to uninterrupted availability.


§ 3 Registration and User Account

(1) Use of the Service requires registration. Registration is possible from the age of 16.

(2) Truthful and complete information must be provided during registration. The User is obliged to keep their access credentials confidential.

(3) Each User may only create one account, unless multiple accounts are provided for under a Team or Business plan.

(4) The Provider reserves the right to suspend or terminate User accounts in the event of a violation of these Terms, after prior warning.


§ 4 Plans and Scope of Services

(1) The Service is offered in the following tiers:

Free: Registered users receive 20 queries per day, access to Tier 1 and 2 models, Turntable mode and sliders. Chat history is stored for 7 days.

Starter (€ 9.99 per month, incl. VAT): 300 queries per month with a daily limit of 30 queries, access to Tier 1–3 models, 30-day chat history and email support.

Pro (€ 17.99 per month, incl. VAT): 800 queries per month with a daily limit of 50 queries, access to all models (Tiers 1–4), 5 Battle/Trio comparisons per month, 3 Deep Research queries per month, 20 image generations per month, unlimited chat history and priority email support.

Team (€ 14.99 per seat per month, incl. VAT): From 2 seats, 500 queries per seat per month, access to all models, shared team history and basic admin dashboard.

Family (€ 14.99 per month flat, incl. VAT): 1 main account and up to 4 sub-accounts, 500 shared queries per month, age rating filters and parental controls.

Business (€ 24.99 per seat per month, incl. VAT): From 3 seats, 1,000 queries per seat per month, full admin dashboard with audit features, SSO integration and support within 24 hours.

(2) An annual subscription provides a 20% discount compared to the monthly billing price.

(3) All prices are in euros and include the statutory Austrian VAT of 20%.

(4) The Provider is entitled to adjust subscription prices with 30 days' prior notice by email. The User has the right to cancel the subscription before the price change takes effect.

(5) Unused queries from a billing period expire at the end of that period and are not carried over.

(6) If the monthly query quota is exceeded, the User is placed in Budget-Out mode, in which only Tier 1 models are available. The Service is not suspended.


§ 5 Credits, Query Packs and Add-Ons

(1) In addition to the chosen plan, users on paid plans may purchase the following add-on packs:

Query packs: Mini (50 queries for € 1.99), Standard (150 queries for € 4.99) and Boost (350 queries for € 9.99). All prices incl. VAT.

(2) Each AI query incurs costs that depend on the model used and the token volume. The actual costs are displayed transparently in the User account after each query.

(3) Purchased query packs and API credits are valid for 12 months from the date of purchase. After this period, unused credit expires. The Provider will notify the User by email at least 30 days before expiry.

(4) Credits are neither transferable to other users nor redeemable for cash. They do not constitute e-money within the meaning of the E-Money Act.


§ 6 Early-Bird Offers

(1) At launch, the Provider offers a tiered Early-Bird programme. The programme comprises 8 tiers in which the price for 3 months of Pro access increases incrementally from € 1.00 (Tier 1) to € 8.00 (Tier 8).

(2) Upon completion of the Early-Bird offer, the User receives the Pro plan for 3 months. The offer then ends automatically without automatic renewal.


§ 7 Contract Formation, Duration and Cancellation

(1) A contract is formed when the User completes the registration process (Free plan) or places an order via the Platform's payment page.

(2) The Free plan contract is concluded for an indefinite period. Paid plans have the duration specified at the time of order.

(3) Monthly subscriptions renew automatically for one additional month unless cancelled at least 14 days before the end of the current billing period.

(4) The right to extraordinary termination for good cause remains unaffected.

(5) Cancellation may be made informally — in particular by email to jockey@discode.ai, via the customer portal in account settings, or by letter.


§ 8 Right of Withdrawal and Its Expiry

(1) If you are a consumer within the meaning of the KSchG, you are generally entitled to a statutory right of withdrawal pursuant to § 11 FAGG.

(2) By completing your order, you expressly consent to the Provider commencing the provision of the digital service immediately upon conclusion of the contract, and you acknowledge that you lose your right of withdrawal as a result (§ 18 para 1 Z 11 FAGG).

(3) Your right of withdrawal therefore expires upon first access to the Service or first use of a paid feature (subscription activation, credit redemption, query pack usage).

Notice on the Expiry of the Right of Withdrawal

As a consumer, you are generally entitled to a right of withdrawal pursuant to § 11 FAGG. However, by completing your order you expressly consent to the Provider commencing the digital service immediately upon conclusion of the contract.

You simultaneously acknowledge that you lose your right of withdrawal once the Provider has begun performing the contract (§ 18 para 1 Z 11 FAGG).

Since the service (access to the Platform, processing of AI queries, activation of credits) begins immediately upon conclusion of the contract, your right of withdrawal expires upon first access to the Service or first use.


§ 9 Payment

(1) Payment processing is handled by the payment service provider Stripe Payments Europe Ltd., Block 4, Harcourt Centre, Harcourt Road, Dublin 2, Ireland. The Provider does not store any credit card data.

(2) The following payment methods are accepted: credit card (Visa, Mastercard), PayPal, SEPA direct debit (for annual subscriptions) and other methods available via Stripe.


§ 10 AI-Generated Content and Transparency Notices

(1) AI notice: All responses, texts, images and videos generated via the Platform are produced by artificial intelligence systems.

(2) No guarantee of accuracy: AI-generated content may be factually incorrect, incomplete, outdated or otherwise erroneous. The Provider assumes no liability for the accuracy of AI outputs.

(3) No professional advice: AI-generated content does not constitute legal, medical, tax, financial or any other professional advice.

(4) Eco Score: The Eco Score displayed on the Platform is a beta feature. The displayed values for CO₂ emissions and water consumption are estimates, not measured values.

(5) Battle and Trio mode:In Battle and Trio modes, your query is simultaneously sent to up to three different AI models from different providers. The responses are then summarised by a fourth model (“Judge”). This means your input is forwarded multiple times to different third-party providers — potentially in different jurisdictions.

(6) Data storage: Your chat histories are stored in an encrypted database in the EU (Frankfurt) and protected by Row-Level Security (RLS), so that only you can access your own data. Data is stored as plaintext within the encrypted database. When you delete chats, they are first marked as deleted (soft delete) and permanently and irreversibly removed after 30 days.

(7) Chinese AI models:Some of the available AI models (DeepSeek, Qwen, Kimi, MiniMax) are operated by providers based in the People's Republic of China. These models are disabled by default. If you enable the “China toggle”, you consent to your query data being transmitted to servers in China. There is no EU adequacy decision for China. Details can be found in our Privacy Policy, Section 7.2.


§ 11 Liability

(1) The Provider is liable without limitation for damages arising from injury to life, body or health caused by negligent or intentional conduct.

(2) The Provider is liable without limitation for damages caused by intentional or grossly negligent conduct.

(3) In cases of slight negligence, the Provider is only liable for breach of material contractual obligations. In such cases, liability is limited to the foreseeable, contract-typical damage.

(4) Liability under the Product Liability Act (PHG), the Consumer Warranty Act (VGG) and other mandatory statutory provisions remains unaffected.


§ 12 User Obligations and Prohibited Use

The User undertakes to use the Platform only in accordance with applicable laws. In particular, the following are prohibited:

  • Generation of unlawful, discriminatory, insulting or violence-glorifying content
  • Systematic or automated mass queries (scraping, bots)
  • Circumvention of security measures or access restrictions
  • Paid or unpaid sharing of access with third parties
  • Publication of AI-generated content without labelling, insofar as a labelling obligation exists under Art. 50(4) AI Act

§ 13 Data Protection

The collection, processing and use of personal data is carried out in accordance with the GDPR, the Austrian Data Protection Act (DSG) and our separate Privacy Policy, available at discode.ai/privacy.

User data is not used for training AI models. The Provider exclusively uses business and API access from third-party providers where training with customer data is contractually and technically excluded.


§ 14 Intellectual Property and Usage Rights

(1) All rights to the Platform belong to the Provider or its licensors.

(2) Usage rights to AI-generated outputs are governed by the respective terms of use of the third-party providers. The Provider assumes no guarantee that AI-generated content is free from third-party rights.


§ 15 Service Changes

(1) The Provider is entitled to further develop the Service and to expand, update or technically adapt its scope of features.

(2) Changes that materially restrict the scope of services will be communicated to the User by email at least 30 days in advance.


§ 16 Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. The Provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.


§ 17 Applicable Law and Jurisdiction

(1) Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) The place of jurisdiction for all disputes is Vienna, Austria. For consumers, the jurisdiction of their domicile applies pursuant to § 14 KSchG.


§ 18 Severability Clause

Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall not be affected.
